So I have a question. We have a neighbor who supposedly has leased his 100 acres out to be used for a solar plant and 100 acres across the road from us and supposedly have permit to go under road already. Supposed to start 2021 or 2022 according to neighbor. Now we have researched for tax abatements, went to courthouse and the county judges secretary has gone through all the files for solar plants which there is 1, but we/she checked and none of those 3 sites are in our area. She knows nothing about one and neither did the county clerk coming in our area. We will go back and talk to county judge this week.
So, could our electric company be able to do all of this without the
County clerk, county judge and his secretary not knowing about it?
The top of the contract is Milam County Solar Company, LLC.
The judge's secretary and county clerk have never heard of it.
Now the secretary also told us someone came in with a letterhead with that on top and signed by the county judge. He said that he didn't sign it and didn't even know of this company
So confused.

Check with whoever handles the zoning for your area . Could be the County or the the Township .

He had already left, but his secretary looked through all the files. We were hoping to find a project name. She was very helpful.

They layer the LLCs - go on your state website and find the llc and look to see who owns the LLC or who is the registered agent - sometimes you can find it that way. They are sneaky tho, and sometimes have a 3rd party.

I can't help with your question but leasing land to an LLC is a big no no for landowners. Even though they all fall for it. Try sending a copy of this to the landowner...

Can you elaborate? I have a solar company here that has leased over 1200 contiguous acres from 3 separate property owners. Neighbors managed to delay approval at the last planning meeting but I recently found out the county solicited this project. We have some immoral unethical local government around here.
At least one neighboring property owner is going to have solar panels on 3 sides of her house, less than 250 ft on one side.

I think the link I included explains it better than I can. LLP = LIMITED liability. If you were a landowner would you want someone doing something on your land that only takes on some of the liability? LLP goes bust and the landowner is left with whatever wasn't covered by the limited liability. Even if the LLP doesn't go bust, the landowner may still find themselves being liable.

Thanks, got it.
The solar company has had the land leased for 2 years prior to making application at the planning commission.
This is a nightmare for those of us that live around the property.
We're hoping incompatibility with the county comprehensive plan land use categories can stop it.

You can research by landowner name to get project name. Check your recorders office.
